Terms and Conditions of Service

 

iRemit To The Philippines Pty. Ltd. provides money remittance (the Services) to you under the following terms and conditions:

  Warranty and Liability  

The Services are provided on “AS IS” basis and iRemit To The Philippines Pty. Ltd.disclaims all warranties or representations of any kind whether express or implied about the features of the Service. iRemit To The Philippines Pty. Ltd.makes no warranty that the Service will meet your requirements and that the same shall be uninterrupted, secure or error-free.

 

You understand and agree that iRemit To The Philippines Pty. Ltd.shall not be liable for the following: any direct, indirect, incidental, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill or any other tangible or intangible losses resulting from the use or inability to use the Service; any unauthorized access to or alteration of information you have provided; statements or conduct of any other party on the Service; or any other matters relating to the Service.

 

iRemit To The Philippines Pty. Ltd.will not be responsible for delay or failure of delivery due to accidents, traffic problems, power failures, floods or other natural disasters. It also reserves the right to refuse delivery in cases of political unrest or natural disasters which in its own absolute judgment may put its partners, officers or employees into some form of danger.

  Accuracy of Information and Remittance Instruction  

You agree to provide true and accurate information as required upon registration about your self and submit the necessary documents are requested by us prior to the use of the Service.

 

You agree to promptly update the data whenever necessary to keep it true and accurate. Your customer ID number is for your use only.  Sharing of numbers is strictly prohibited. If you provide information that is not true or accurate, iRemit To The Philippines Pty. Ltd.has the right to suspend or terminate your account and/or disallow you from using the Service.

 

You agree to provide complete and accurate information about the recipient necessary to effect successful delivery of your remittance. iRemit To The Philippines Pty. Ltd.shall not be held accountable for failure of delivery due to erroneous or fictitious recipient information.

 

You agree to respond and / or provide written instruction on amendments to iRemit to the Philippines via your registered email address only. Any instruction not coming from your registered email address will not be acknowledge.

 

If you wish to alter your request, we may be entitled to charge you an additional service fee plus any bank charges or loss incurred due to the error or alteration.

 

If the information provided by you via the remittance form and/or your registered email address is inaccurate in any manner, you agree to hold iRemit To The Philippines Pty. Ltd.free and harmless from any delay in delivery, error in delivery or failed delivery.

  Fees, Payment and Currency Exchange  

In consideration for the use of our services, you agree to pay to iRemit To The Philippines Pty. Ltd.a fee for each money remittance initiated by you at the applicable rate then in effect and for the cost of items displayed on the website plus the applicable delivery fees. The applicable remittance fee for your transaction will be provided to you prior to your final authorization of the transaction, apart from any applicable fees for additional services.

 

All payments will be made in the Philippine Peso currency. In addition to the remittance fees applicable to this transaction, a currency exchange rate will be applied.

 

The remitters’ currency is converted to Philippine Peso at an exchange rate set by iRemit To The Philippines Pty. Ltd.on the day the remittance request is received. The rate of the day is valid only until 5.00 pm AEST Monday to Friday. Remittance requests received after the daily cut-off shall be treated as a transaction at next business day and will be subject to our usual processing time. The term “business day” shall mean any day in which commercial banks are open for business in Sydney, Australia, excluding Sundays and legal holidays.

 

Payment, Remittance fees and the principal amount are due within the same day you provide your remittance request and payable when iRemit To The Philippines Pty. Ltd.processes the transaction. You must pay for the Service by direct deposit or internet transfer. If payment is not received, we will cancel your transaction. Payment done by cheque is subject to banking clearance. In the event of dishonoured or bounced cheque you are to pay by cash( notes) in replacement of the dishonoured or bounced cheque we will cancel your transaction we shall be entitled to charge you an additional service fee plus any bank charges or loss incurred.

  Refunds  

Refunds of Principal Amount and cancellation of the Money Remittance will be made upon written request of the Sender if payment to the Recipient has not yet been made at the time the request is processed within the time specified by iRemit To The Philippines Pty. Ltd.for the selected service.

 

In the event of a cancellation the service fee is non-refundable. In the event of a re-process or an amendment iRemit To The Philippines Pty. Ltd. may charge an additional processing fee.

  Refunds will be made within Five (5) days of receipt of a valid written request from the Sender.   Written requests must come from the registered email address of the Sender.   Right to Refund  

The customer is entitled to a refund of the money to be remitted as the result of this agreement if iRemit To The Philippines Pty. Ltd.does not forward the money received from you within five  (5) days of the date of its receipt, or does not give instructions committing an equivalent amount of money to your designated recipient within 5 days of the date of the receipt of the funds from you unless you otherwise instruct.

 

If your instructions as to when the moneys shall be forwarded or transmitted are not complied with and the money has not yet been forwarded or transmitted, you have a right to refund your money.

  Modification / Termination of Service  

We reserve the right at any time to modify, update or discontinue, temporarily or permanently, the Service with or without notice. iRemit To The Philippines Pty. Ltdshall not be liable to your or to any third party for any modification, suspension or discontinuance of the Service. However, we commit to continue to deliver based on instructions already received at the time of the discontinuance.

 

You agree that iRemit To The Philippines Pty. Ltd., in its sole discretion, may terminate your account for any reason, including its belief that you have violated the terms of the Service.

 

You agree that such termination of your access to the Service and/or deletion of your account and all related information and files may be effected without prior notice. You further agree that iRemit To The Philippines Pty. Ltd.shall not be liable to you or to any third party for such termination.

 

You have the right to terminate your use of the Service, for any reason whatsoever, by upon written request informing iRemit To The Philippines Pty. Ltd.of your intentions.

  Amendments and Changes  

This Agreement is subject to change by iRemit To The Philippines Pty. Ltd. at its sole discretion (without prior notice unless required by law), by posting of the revised Agreement on our website. Such postings will remain in our website and will immediately be incorporated into this Agreement.
